（軍聞社記者周昇煒臺北十二日電）立法院司法及法制、外交及國防委員會今天初審通過「陸海空軍刑法第44條條文修正草案」，明確規範「凌虐」定義，國軍部隊實施「從嚴從難」的教育、訓練及勤務，也能兼顧保障軍中人權。

　立法院初審通過的修正條文中，明確定義「凌虐」為「逾越教育、訓練、勤務、作戰或其他軍事之必要，使軍人受凌辱虐待之非人道待遇行為」；至於「教育、訓練、勤務、作戰或其他軍事必要之實施範圍及應遵行事項，由國防部以準則定之」。

　國防部副部長嚴德發上將表示，本次各項修正草案通過後，將「凌虐」罪行明確定義，不但有效保障軍中人權，並讓國軍各級幹部在準則的規範下，可以戮力執行各項教育訓練工作，確保國軍部隊正常運作。
