提審法保障自由 可望明年底上路

比國內憲法更早制定的「提審法」首度大幅修正，過去司法實務大多將提審事由限縮在「因犯罪嫌疑被逮捕、拘禁」，但是修法後，只要是被法院以外的任何機關逮捕、拘禁，例如移民署、陸委會下屬單位或是軍人遭關禁閉，不論是否有犯罪嫌疑，本人或他人都可聲請提審，由法官介入審查程序的合法性，避免行政法規剝奪人身自由。

司法院指出，修正後的提審法十月底已送交立法院審議，可望今年十二月通過審查，明年底正式上路。
